Terms of Service — Witnes

1. Acceptance of terms
By accessing or purchasing from witnes.shop you agree to these Terms of Service. If you do not accept them, do not use the Site.

2. Seller information
This website is operated by:

3. Products

  • Products are manufactured after an order is placed. (Made-to-order.)

  • Product images are mockups; minor variations in colour, size, or print placement may occur. These are not defects.

  • Products are not customizable  as specified on the product page. 

4. Prices & payments

  • Prices shown at checkout are final for that transaction and include taxes where required.

  • We accept the payment methods displayed at checkout.

  • We reserve the right to change prices at any time for new orders only.

5. Order acceptance & cancellations

  • Orders are accepted once payment is processed.

  • Cancellations
    You may request cancellation of your order within 24 hours of placing it, provided that production has not begun.

    An order is considered to have entered production once it has been submitted to the production partner (e.g. when the order status changes to “in production” or “sent to print”).

    If production has already begun, the order can no longer be cancelled or modified, as the item is made specifically for you.

    To request a cancellation, contact us as soon as possible at witnesclothing1@gmail.com with your order number. We cannot guarantee cancellation requests submitted after production has started.

6. Production, shipping & delivery

  • Production time: typically 2–7 business days before shipment, depending on product and order volume.

  • Shipping times: vary by carrier and destination and are separate from production time — estimated at checkout.

  • Tracking: once shipped, you will receive a tracking number by email. Allow up to 48 hours for tracking updates to appear.

  • Delays caused by carriers, customs, or other third parties are outside our control. Customers are responsible for customs, duties, and import taxes where applicable.

7. Right of withdrawal & returns (EU consumers)

  • Because our products are made to order / personalized, the standard 14-day cooling-off right under EU distance sales law does not apply, except where the product is defective or does not conform to the contract.

  • If you receive a defective or incorrect item, contact us within 14 days of delivery at witnesclothing1@gmail.com with your order number and photos. We will inspect the issue and offer repair, replacement, or refund as required by law.

  • Consumers in the EU retain their statutory rights (including the 2-year legal guarantee of conformity). Remedies under that guarantee (repair/replacement/refund) apply in addition to our policy.

8. Refunds

  • If a return or refund is approved, we will refund the original payment method. Refunds are processed within 14 business days of verification. Bank processing times may vary.

9. Accounts
Customers are responsible for maintaining the confidentiality of their account credentials. We reserve the right to suspend or terminate accounts for fraud, abuse, or violation of these Terms.

10. Intellectual property
All site content — designs, logos, images, text, graphics — is the intellectual property of Witnes or its licensors. Purchasing a product does not transfer ownership of designs, nor grant permission to reproduce or resell them for commercial use.

11. Third-party services
We rely on third parties for hosting, payments, production, and shipping. We are not responsible for interruptions, errors, or delays caused by these providers.

12. Limitation of liability
To the fullest extent permitted by law, Witnes is not liable for indirect, incidental, or consequential damages arising from use of the Site or products. Nothing in this clause limits consumer rights that cannot be excluded by applicable law.

13. Governing law & dispute resolution
These Terms are governed by the laws of Romania. For EU consumers: if you have a complaint, you may contact us first by email at witnesclothing1@gmail.com. You may also use the EU Online Dispute Resolution (ODR) platform for cross-border complaints: the EU ODR platform. (Add link to ODR on your site.)

14. Changes to these Terms
We may update these Terms; we will post changes on this page. Continued use of the Site after changes constitutes acceptance.
